US Tax CPA for Americans in Portugal

Portugal has changed its rules for new arrivals more than once, and every version of them lands somewhere on an American return. A year with little Portuguese tax is a year with little foreign tax credit, and the bill moves rather than disappears.

We prepare the US side for Americans in Portugal: the return, the elections, and the planning that decides which country ends up taxing what.

What your Portuguese position does to your US return

Your Portuguese accountant handles the Portuguese side. Our job is the part that lands on your 1040 — and the two do not always point the same way.

The regime

NHR and after

Portugal’s regimes for new residents have changed, NHR among them. Whatever position you hold locally, the United States still taxes its citizens on worldwide income — and the IRS credits only tax you actually paid.

  • Less Portuguese tax paid
  • Less credit on Form 1116
  • The saving can move to the IRS

On your 1040

Both directions

Relief in Portugal shrinks your credit on the income it shelters. Portuguese tax on income it does not shelter grows it. The two effects pull opposite ways, and which one wins depends on your mix.

  • Less credit on sheltered income
  • More credit on the rest
  • Your mix decides it

Two systems

Reporting twice

Portuguese filings do not satisfy anything on the US side. FinCEN 114 and Form 8938 have their own thresholds, their own deadlines and their own penalties, and they are filed with the US return.

  • FBAR and Form 8938 still due
  • Different thresholds entirely
  • Separate penalties

Before you file

The two returns should be decided together

Most of the expensive mistakes we see were made on the Portuguese return months before anyone looked at the American one. We would rather be in the room for that conversation than clean up after it.

What we do for Americans in Portugal

US filings, prepared with the Portuguese position in front of us rather than after the fact.

Compliance

The annual return

Form 1040 with the schedules an expat life actually generates — Forms 2555, 1116, 8938 and FinCEN 114 — plus any state return you have not shaken off.

  • Federal and state returns
  • FBAR and FATCA reporting
  • Extensions to October 15

Reliefs

Credit planning

Exclusion or credit is arithmetic, not preference. We run both before choosing, and we watch the carryforwards.

  • Exclusion up to $132,900 for 2026
  • Foreign tax credit carryforwards
  • The effect of a local claim

Retirement

Pensions

Portuguese and US retirement arrangements, treaty positions taken deliberately, and the US reporting that goes with them.

  • Contributions and growth
  • Lump sums and drawdown
  • Reporting on the US return

Investments

Funds and accounts

A Portuguese fund typically meets the test for a passive foreign investment company, which is a separate and expensive US filing.

  • PFIC testing on each holding
  • Form 8621 and the elections
  • Section 1291 exposure

Family

Estate exposure

US estate tax follows citizenship wherever you live, with a basic exclusion of $15,000,000 for 2026.

  • Where two systems overlap
  • Non-citizen spouse limits
  • Planning before it matters

Late filers

Catching up

Streamlined Foreign Offshore takes three years of returns and six years of FBARs, with no offshore penalty where the failure was non-willful.

  • The non-residency test
  • Non-willful certification
  • Penalty relief

How the work runs

Step 1

Review

We read last year’s US return, your residence timeline and your account and pension statements, and tell you where the exposure sits.

Step 2

Plan

Exclusion or credit, what your Portuguese position costs on the US side, what to do about funds — settled before anything is filed.

Step 3

File

We prepare and file the US returns and information reports, and coordinate with your Portuguese accountant so both sides agree.

US expat tax in Portugal — questions we get

Does a Portuguese tax regime help or hurt me as an American?

It can do both, and which one wins is a US calculation. Any regime that lowers the Portuguese tax on your income lowers the foreign tax credit you can claim, because the IRS credits only tax you actually paid. The United States taxes its citizens on worldwide income either way, so relief in Portugal can simply move the tax to the IRS.

It is not always the wrong answer — US rates or timing may suit you. But it should be a calculation before your Portuguese return is filed, not a discovery afterwards. Your Portuguese adviser makes the claim; we tell you what it costs on the American return.

Which side do you actually handle?

The US side, and only the US side. We are a US CPA practice: we prepare the 1040 and the international schedules that go with a life abroad, run the elections and credit calculations, and handle the account and pension reporting. We do not prepare Portugal returns and we are not Portuguese tax advisers.

What we do bring is the American consequence of your Portuguese decisions, which is the part that usually goes unexamined. Where you have a local accountant we coordinate with them so both returns tell the same story. More detail: our US expat tax guide, our international tax services, and expat support in other countries.

NHR has changed. Does that change my US filing?

Your US filing obligation does not change — it never depended on your Portuguese status. What changes is the arithmetic underneath it. More Portuguese tax paid means more foreign tax credit available; less means less, and the US charge on the same income stands either way.

So a change in your local position is a reason to revisit the US side, not a reason to assume it is handled. That is the review we would do first.

Why are my Portuguese funds a problem on a US return?

A foreign corporation is a passive foreign investment company if 75% or more of its gross income is passive, or at least 50% of its average assets produce passive income. A Portuguese fund will typically meet one of those tests.

Without a qualified electing fund or mark-to-market election, distributions and gains fall into the section 1291 excess distribution rules, which throw the gain back over your holding period and add an interest charge. Each holding is reported separately on Form 8621 — so a portfolio assembled sensibly by a local adviser can produce a long and expensive US filing.

Should I use the exclusion or the foreign tax credit?

It depends on how much local tax you actually pay. The foreign earned income exclusion covers up to $132,900 of earned income for 2026 but does nothing for investment income, and taking it means the foreign tax paid on the excluded income is not creditable. The credit has no such ceiling but only helps to the extent local tax was paid.

In a high-tax year the credit usually wins and builds carryforwards. In a year where a local regime has sheltered your income, neither does much, and the US bill is simply the US bill. We run it both ways.

My spouse is not a US citizen. Does that matter?

Yes, and it catches people out. The unlimited marital deduction that lets one US spouse leave everything to the other does not apply where the recipient spouse is not a US citizen. Lifetime gifts to such a spouse are limited to an annual exclusion of $194,000 for 2026, and transfers at death generally need a qualified domestic trust if the tax is to be deferred. Worth planning years ahead.

I have not filed US returns since moving. What are my options?

The Streamlined Foreign Offshore Procedures exist for exactly this. They require three years of returns, six years of FBARs, and a certification that the failure was non-willful — due to negligence, inadvertence, mistake, or a good faith misunderstanding of the law — along with physical presence outside the United States for at least 330 full days in one of the relevant years.

Where the requirements are met, the IRS states the taxpayer will not be subject to failure-to-file and failure-to-pay penalties, accuracy-related penalties, information return penalties, or FBAR penalties. Most people who simply did not know are eligible.
